Version 2026-10d · Last updated: 14 October 2026
DRAFT – to be reviewed by a qualified Indian lawyer before public launch.
These Terms are an agreement between you and Nanchar Global Enterprises (OPC) Private Limited ("Nanchar", "we", "us"), the company that owns and runs the Drive Wacho app, its Command Center and related services (together, the "Service"). In these Terms, "Drive Wacho Parties" means Nanchar, its owner, directors, employees, Command Center staff, developers and builders of the app, and the promoters, distributors, resellers and sellers of the Service.
Drive Wacho supports you in road emergencies. It is not an emergency service and does not replace police, ambulance or fire services. In danger, always call 112 (national emergency) or 108 (ambulance) yourself if you can.
The most important points, in short:
- By tapping "I agree" / "Agree and continue" you accept these Terms, our Privacy Policy and our Refund and Cancellation Policy, and all the activities and features of the Service described in them – including the tracking, monitoring and sharing listed in section 3.
- No guarantee. Drive Wacho tries to reduce emergency risks and to get help to you faster. It does not promise, assure or guarantee that an accident, injury, death or loss will not happen, or that help will arrive in time.
- You accept the risks of the road (section 6) and that the Service depends on other companies and may not always work (section 5). The Drive Wacho Parties do not give any guarantee for the life, health or safety of anyone using the Service, travelling with someone who uses it, or paying for it.
- To the fullest extent Indian law allows, you and those who claim through you give up claims against the Drive Wacho Parties, and our total liability is limited (sections 13–15). Disputes go to arbitration (section 17).
1. Who can use Drive Wacho
- You must be 18 years or older, legally able to make a contract in India, and use your own correct mobile number. If someone under 18 uses the Service by giving false details, their parent or guardian is responsible.
- If you drive, you must hold a valid driving licence and follow the Motor Vehicles Act, 1988 and all traffic rules.
2. What the Service does – and what it is not
- Trip protection: while protection is on, the app records your trips, watches for a possible crash and asks if you are OK.
- SOS: you can raise an alert from the app, the lock screen or the home-screen widget on every plan, and with a Bluetooth SOS button you pair yourself on Prime and higher plans (co-passenger buttons on Family and higher).
- Prime Response / Business plans: our 24/7 Command Center receives your alerts, tries to reach you and, when needed, informs your family contacts and nearby police, hospitals or ambulance services.
- Basic plan (free): SOS and crash alerts are sent as an app notification to one family member who has the Drive Wacho app (the first such contact in your list); no SMS is sent. If none of your contacts has the app, nobody is alerted, so call 112 yourself. Prime and higher plans also send an SMS and an app notification to all your family contacts. The Command Center handles alerts only on Prime Response and Business plans.
- Other features (trip history, driving score, spoken warnings, accident-area warnings, tiredness reminders, family view, parental monitoring, adding cars and drivers, emergency QR sticker, black box) depend on your plan, as shown in the app and summarised in section 11.
- Not insurance. Drive Wacho is a safety-support service. It is not an insurance product and does not provide any insurance cover, compensation or claim settlement. Your driving score and data are never shared with any insurance company unless you separately agree to it.
- Not medical or police advice. Command Center staff are trained to coordinate help. They are not doctors, paramedics or police officers. Anything they say is general guidance, not medical, legal or professional advice. Always follow the instructions of police, ambulance and medical staff.
3. What you agree to by accepting
By accepting these Terms you agree that the Service may carry out all of the following. The full detail of each is in the Privacy Policy.
| Activity | What it means |
| Location tracking | Your phone's location is collected all the time while protection is on, also when the app is closed or not in use, to detect trips, record routes and send your position in an emergency. |
| Driving monitoring | Speed, braking, acceleration, sharp turns, phone unlocks and calls without hands-free while driving, driving time and tiredness, the type of vehicle (car, train, bus, two-wheeler) and whether the phone is in a holder or pocket. |
| Crash detection | Motion sensors, air pressure, GPS and (only if you allow the microphone) a 3-second loudness check after a strong jolt. Nothing is recorded as sound. |
| Black box | About 30 seconds of sensor readings and GPS around strong jolts, hard stops and phone drops (no sound, no video). |
| Bluetooth | Detecting your car's Bluetooth and a paired SOS button. |
| Sharing in an emergency | Your name, phone number, car, live location, trip and medical card go to your family contacts, the Command Center (if your plan includes it) and police, hospitals and ambulance services. |
| Sharing you choose | Family view, parental monitoring, live trip links, car sharing and the emergency QR sticker share what each feature describes, only after you (and, where needed, the other person) turn them on. |
| Staff access | Authorised Drive Wacho staff, who have signed a Non-Disclosure Agreement and confidentiality pledge, can see your data to provide the Service (Privacy Policy, section 4). |
| Government requests | Your data may be given to government, police, courts and other authorities on their official request for legal reasons (Privacy Policy, section 5). |
| Road-safety alerts | Your location while driving is compared with accident areas and accidents reported nearby, so you can be warned. |
| Messages to you | Service calls, SMS, WhatsApp messages, app notifications and spoken warnings about your safety, account and plan. |
| Service improvement | Driving data, black-box recordings and operator labels are used to improve crash detection and the driving score; data that no longer identifies you may be used and shared for road safety (Privacy Policy, section 8). |
Optional items (microphone check, medical card, safety tips, family view, parental monitoring, live links, Bluetooth button, photos) are used only if you turn them on, and you can turn them off at any time.
4. No guarantee – what Drive Wacho can and cannot do
- Drive Wacho is a support service that tries to help you avoid and respond to road emergencies. The Drive Wacho Parties do not promise, assure or guarantee that the Service will prevent any accident, injury, death, damage or loss, or that it will work 100% of the time.
- Crash detection, two-wheeler and train detection, driving scores, spoken warnings, accident-area warnings and tiredness reminders are based on phone sensors and may be missed, late or wrong (for example a missed crash or a false alarm).
- We pass information to police, hospitals and ambulance services, but we do not control whether, how or how fast they respond, and we are not responsible for their actions, decisions or treatment.
- The emergency directory, maps, road data and accident areas come partly from public and third-party sources and may be incomplete or out of date.
- Costs of emergency services are yours. Drive Wacho may help contact police, ambulance, hospitals, towing or other services, but all charges for those services – ambulance, hospital admission, treatment, medicines, towing, repairs or any other cost – are the responsibility of the user or their family. We do not pay for, guarantee or arrange payment for any such service.
- The Service is provided "as is" and "as available", without any warranty of any kind, to the fullest extent the law allows.
5. Services from other companies, and availability
Drive Wacho is built using services provided by various Indian and global companies, including (as examples) cloud servers and databases (Google Cloud), maps and places (Google Maps, OpenStreetMap), background location and motion tracking (Transistorsoft), push notifications (Google Firebase), SMS and calling providers, payment processing (Razorpay), and the services of mobile network operators, phone makers and Google Android / Play.
The Service depends on these companies and on systems outside our control. The Service, or any part of it, may at any time not work, work only partly, work late, or stop, for reasons including:
- technical reasons – outages, bugs, updates, server, database or network failures, GPS or sensor errors, phone settings, battery or operating-system restrictions;
- non-technical reasons – changes, suspension or ending of a third-party service, changes in law or government orders, natural events, strikes or other events beyond our control;
- financial or commercial reasons – changes in the cost, terms or availability of third-party services, or our business decisions to change, suspend or discontinue a feature or the Service;
- any other reason.
By accepting these Terms you agree to accept this. To the fullest extent the law allows, the Drive Wacho Parties are not liable for any loss, injury, death or damage caused by the Service, or any part of it, not working fully or partly, for any of these reasons. We are not responsible for the services, actions or failures of these third-party companies.
6. Risks of the road – you accept them
Road travel always carries risk. Accidents and emergencies can happen whether or not you use Drive Wacho, including because of:
- road conditions – potholes, construction, poor lighting, weather, animals, signage, road design;
- the driver – alertness, tiredness, speed, distraction, health, alcohol or drugs, experience;
- the vehicle – its condition, maintenance, brakes, tyres, lights;
- co-passengers and co-travellers in your vehicle;
- other road users – other drivers, riders, pedestrians and vehicles on the road;
- events outside anyone's control (natural events, network outages, power cuts, acts of others).
You understand and accept these risks. The Drive Wacho Parties give no guarantee for the life, health or safety of any user, any person travelling with a user, or any person who pays for the Service. You remain fully responsible for driving safely, obeying the law and your own and your passengers' safety.
7. Your responsibilities
- Phone use while driving: using a hand-held phone while driving is an offence under the Motor Vehicles Act, 1988. Set up the app before you start driving. You alone are responsible for how you use your phone while driving and for any fine or penalty.
- Keep protection on, location set to "Allow all the time", battery restrictions off, and the phone charged, if you want the Service to work.
- Emergency contacts: add a family member or friend only if they agree to it. We send them one WhatsApp message saying they were added and how to be removed.
- Vehicles and passengers: you confirm you have the right to register each vehicle you add (as owner, or with the owner's permission). Data about people travelling with you may be processed only as part of providing the Service.
- Account and OTP: you are responsible for your phone, your SIM and the one-time codes (OTP) sent to you. Tell us at once if your phone is lost or stolen, so we can sign it out.
- Answer when the Command Center calls you, and tell it if you are safe.
7A. Device permissions – your choice, and you can withdraw them
Drive Wacho gives you full flexibility over the device permissions you allow – including location (and "all the time" location), microphone, camera, physical activity, Bluetooth / nearby devices, notifications, battery optimisation, full-screen alarm and any other device access. You give each of them yourself, and you can withdraw any of them at any time, in your phone's settings or in the app (Profile, or by turning protection off).
When you withdraw a permission, the features that need it will stop working or work only partly – for example, without location there is no trip protection, crash detection or emergency location. By accepting these Terms you agree that, to the fullest extent the law allows, the Drive Wacho Parties are not liable for any result of a permission you did not give or have withdrawn.
7B. Other people's details you give us
When you share details of other people with us – for example family members', friends', co-workers' or other drivers' names and phone numbers, relations, vehicle details or any other personal information – you are solely responsible for sharing them. You confirm that:
- you have the right to share these details, and the person knows and agrees that you are giving them to Drive Wacho and that they may be contacted in an emergency;
- the details are correct, and you will update or remove them when they change or when the person asks.
To the fullest extent the law allows, the Drive Wacho Parties are not responsible or liable for any claim arising from details you shared without the person's knowledge or agreement, or that are wrong, and you agree to compensate us for any such claim (section 15). We will still keep these details secure, use them only to provide the Service, and remove them when the person asks us to.
8. Medical card
The medical card (blood group, allergies, note for the doctor) is optional and entered by you. When you save it, you agree that it may be shared with the Command Center, ambulance and hospital staff in an emergency. Drive Wacho does not check it and is not responsible if it is wrong, incomplete or out of date, or for any medical decision taken using it. You can delete it at any time.
9. Reports and photos you send
When you report an accident, a road problem or a QR-sticker emergency (text, photo or location), you confirm it is true to your knowledge. You allow us to use it, show it to other drivers (without your name or number) and share it with authorities. You must not send false, abusive or defamatory reports. You are responsible for what you report.
10. What you must not do
You must not use Drive Wacho to:
- track or monitor anyone without their knowledge;
- raise false alerts, or test the SOS outside the app's practice mode;
- harass or abuse Command Center staff;
- register a vehicle or phone number you have no right to use;
- copy, decompile, reverse-engineer or misuse the app or the Service;
- break any law.
We may warn you, suspend or close the account, and report misuse to the police. Repeated false alerts may lead to suspension.
11. Plans and payments
- Plans:
- Basic (always free): SOS, spoken speed warnings, crash detection with "Are you OK?", one emergency app notification to one family member who has the app (no SMS), in-app notices to one family member, trips of the last 7 days, basic driving score, road and accident-area warnings, tiredness reminders, one car.
- Prime (yearly): everything in Basic, plus a Bluetooth SOS button, several cars, adding drivers to your cars (a driver stays until you remove them), full trip history, detailed score, trends and badges, weekly report, trips per car, black box, and emergency WhatsApp + app notification to all your family contacts.
- Family (yearly): everything in Prime, plus a family group, trip-start and arrival notices, parental monitoring and Bluetooth SOS buttons for co-passengers. Only a car's owner can add or remove that car's drivers.
- Prime Response (yearly): everything in Family, plus the 24/7 Command Center and automatic checks.
- Business / Fleet: by written contract.
Each paid plan can be tried free for 30 days, once per phone number. Plan prices, features and durations are shown in the app before you pay and may change for future periods (see below).
- Payments are processed by Google Play or Razorpay; we do not see or store your card or bank details.
- Refunds follow our Refund and Cancellation Policy. A plan that has started is not refunded, except as that policy says.
- If we permanently stop a paid feature or the whole Service for our own business reasons before your paid plan ends, we will refund the unused part of the plan fee for that feature on a pro-rata basis. This is our only obligation in that case.
- Paying for a plan buys access to the features listed for it. It does not buy any guarantee of safety, rescue or outcome.
- We may change prices or features for future periods with notice in the app.
12. Your account
- You can stop protection, withdraw consents or delete your account at any time in Profile.
- We may suspend or close an account that breaks these Terms or the law. SOS stays available where we can safely allow it.
13. Release and waiver of claims
To the fullest extent permitted by Indian law, you – for yourself and, as far as the law allows, for your legal heirs, family members, nominees, friends, well-wishers and anyone claiming through you or on your behalf – agree that the Drive Wacho Parties are not liable, and that no claim, complaint, suit or other legal action will be brought against them, for any death, injury, illness, accident, damage, delay or loss arising from:
- road accidents or emergencies, whatever their cause (section 6);
- the Service, or any part of it, not working fully or partly, for any reason (section 5);
- the Service not detecting, missing, delaying or wrongly reporting a crash or emergency;
- alerts, calls, SMS, notifications or locations that are late, not delivered or wrong;
- the acts, delays, decisions or charges of police, hospitals, ambulance services, family contacts or other third parties;
- data shared in good faith with authorities on their official request;
- your phone, network, settings, battery, or your use or non-use of any feature or warning.
This waiver does not apply where the law does not allow it to – for example where the loss is caused by our own fraud, wilful misconduct or gross negligence, or to any right that cannot be given up under the Consumer Protection Act, 2019 or other law in force.
14. Limit of liability
To the fullest extent permitted by law, the Drive Wacho Parties are not liable for any indirect, incidental, special or consequential loss, or loss of income, profit or data. If we are found liable for anything despite these Terms, our total liability to you and everyone claiming through you, for all claims together, is limited to the amount you paid us for the Service in the 12 months before the claim (or ₹1,000 if you paid nothing).
15. Indemnity
You agree to compensate and hold harmless the Drive Wacho Parties against claims, losses and costs arising from your breach of these Terms, details of other people you shared without their agreement (section 7B), your misuse of the Service, false alerts or reports you raise, or your breach of any law (including traffic laws).
16. Laws that apply
These Terms are governed by the laws of India, including the Indian Contract Act, 1872; the Information Technology Act, 2000 and its rules; the Digital Personal Data Protection Act, 2023 and the DPDP Rules, 2025; the Bharatiya Nagarik Suraksha Sanhita, 2023; the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020; the Motor Vehicles Act, 1988; and the Arbitration and Conciliation Act, 1996.
17. Disputes
- First, contact our Grievance Officer (see the Contact page). We will try to resolve the issue within 30 days.
- If it is not resolved, the dispute will be settled by a sole arbitrator under the Arbitration and Conciliation Act, 1996. The seat of arbitration will be the city of our registered office, and the language English.
- Subject to arbitration, the courts at the city of our registered office have exclusive jurisdiction.
- Nothing here takes away any right you have under law that cannot be waived by contract.
18. Our name, logo and app
The Drive Wacho app, name, logo, designs and content belong to Nanchar Global Enterprises (OPC) Private Limited. You get a personal, non-transferable, revocable right to use the app for its purpose. Nothing else is given to you.
19. Other terms
- Electronic acceptance: ticking "I agree" in the app is a valid electronic agreement under section 10A of the Information Technology Act, 2000. Our record of your acceptance (version, date, time, phone number and IP address) is proof of it.
- Changes: we may update these Terms. For important changes, the app will ask you to accept again before you continue. If you do not agree, you can stop using the Service and delete your account.
- If any part of these Terms is found invalid, the rest stays in force, and the invalid part applies to the fullest extent the law allows.
- These Terms, the Privacy Policy and the Refund and Cancellation Policy are the whole agreement between you and us about the Service. The English version prevails if translations differ.
